In response to Executive Orders (EO) Issued this weekend by U.S. President Trump, U.S. Customs and Border Protection (CBP) issued two notices today with further details on outlining requirements for entry of Canadian and Chinese goods effective February 4, 2025.
Following a discussion between Canadian Prime Minister Justin Trudeau and U.S. President Trump, the U.S. has agreed to postpone tariffs on Canadian imports for 30 days. In CSMS # 63991510 issued this evening, CBP confirmed CSMS # 63988467 was retracted by U.S. President Trump. Additional duties will not apply on February 4, 2025, as outlined in the Executive Order.
Additionally, CSMS # 63988468 provides guidance on additional duties on imports from China confirming the HTSUS classification under 9903.01.20 for all imports from China and Hong Kong at an additional 10 percent duty rate.
This notice addresses products excluded from additional duty including donations, informational materials, and in transit rules that apply. All cargo in transit must be loaded onto a vessel at the port of loading, or in transit on the final mode of transport prior to February 1, 2025, at 12:01 a.m. EST and entered for consumption by 12:01 a.m. EST on March 7, 2025.
As per the Executive Order, certain products of China and Hong Kong are no longer eligible for administrative exemption from duty and tax. They are now subject to additional ad valorem rates of duty. De minimis goods also entered as Section 321 or Entry Type 86 under previous regulatory actions like Section 301 have avoided the preferential tariff increases. The notice confirms that the executive order supersedes the previous regulation. On February 4, 2025, CBP will begin rejecting ineligible entries. The customs broker and importer have the option to issue an informal or formal entry in lieu of a de minimis entry.
As a result of the White House’s Executive Order to impose a 25 percent tariff on imports from Mexico effective on 12:01AM EST on Tuesday, February 4, 2025, Mexican President Claudia Sheinbaum and U.S. President Trump negotiated a 30-day postponement of tariffs on Mexican imports. There is no implementation guidance posted for the Mexico Executive Orders.
