On May 31, 2024, the U.S. Animal and Plant Health Inspection Service (APHIS) announced the implementation of Phase VII of the Lacey Act. The Lacey Act requires declaration of certain plants and plant products at the time of U.S. customs entry. The Lacey Act makes it unlawful to import regulated products without an import declaration. Enforcement of the Lacey Act requirement began in 2009. Phase VII enforcement is scheduled to begin on December 1, 2024. An eighth phase of enforcement is expected to cover composite materials.
This phase is the broadest category of products including items in these headings of the Harmonized Tariff Scheduled (HTS): articles of industrial and medicinal plants; lac, gums, resins, and other vegetable saps; vegetable plaiting materials; essential oils; pyrotechnic products; leather, travel goods, handbags; cork and articles of cork; basketware and wickerwork; footwear; nonwovens, twine, ropes and cables; tools and cutlery; machines, boilers, and nuclear reactors; vehicles; aircraft and spacecraft; boats; optical, photographic, cinematographic, measuring, checking precision; medical, or surgical instruments; clocks and watches; musical instruments; arms and ammunitions; furniture, bedding, mattresses; toys, games, and sporting equipment; and miscellaneous, and articles, thereof.
The agency is seeking comments from stakeholders on the products covered in Phase VII and recommendations for other HTS chapters that should be included. The comment period is open until July 30, 2024.
