On September 22, 2026, U.S. Customs and Border Protection (CBP) issued guidance in Cargo Systems Messaging Service (CSMS)# 69994928 regarding the U.S. Department of Commerce’s Temporary Final Rule (TFR) implementing measures to restrict the stockpiling of polysilicon and polysilicon derivative products under Proclamation 11052, as published in Federal Register Notice 91 FR 60505.

If the Department of Commerce determines that an importer has exceeded its weekly quantity limits for polysilicon imports, the importer will be prohibited from making additional entries of covered products into the United States until December 4, 2026.  Cargo that has already arrived at a U.S. port may be transferred to a bonded warehouse and held until entry is permitted on December 4, 2026.

Importers subject to this prohibition may apply to the Department of Commerce for a waiver.
